Welcome to EasyRentalGuru. These Terms of Service ("Terms") govern your use of our vacation rental management platform operated by Digitallog S.r.l. By accessing or using our services, you agree to be bound by these Terms.

1. Definitions

• "Service" refers to the EasyRentalGuru platform, including all features, applications, and APIs
• "User," "you," or "your" refers to any individual or entity using our Service
• "We," "us," or "our" refers to Digitallog S.r.l., the operator of EasyRentalGuru
• "Content" refers to text, images, data, and other materials uploaded to or generated by the Service
• "Subscription" refers to your paid plan to access the Service

2. Account Registration

2.1 Eligibility

You must be at least 18 years old and capable of entering into a binding contract to use our Service. By registering, you represent that you meet these requirements.

2.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must:

• Use a strong, unique password
• Enable two-factor authentication when available
• Immediately notify us of any unauthorized access
• Not share your account with others

2.3 Account Information

You agree to provide accurate, current, and complete information during registration and to update this information as needed.

3. Service Description

EasyRentalGuru provides vacation rental property management software, including but not limited to:

• Property listing and management
• Channel distribution and synchronization
• Booking and reservation management
• Guest communication tools
• Task and operations management
• Financial tracking and reporting
• Dynamic pricing tools
• Analytics and business intelligence

4. Subscriptions and Payments

4.1 Subscription Plans

We offer various subscription plans with different features and pricing. Current plans and pricing are available at easyrentalguru.com/pricing.

4.2 Billing

Subscriptions are billed in advance on a recurring basis (monthly, quarterly, semi-annually, or annually) depending on your selected plan. All fees are stated in USD unless otherwise specified.

4.3 Payment Methods

We accept major credit cards and other payment methods as indicated during checkout. You authorize us to charge your payment method for all fees associated with your subscription.

4.4 Price Changes

We may change our prices with 30 days' notice. Price changes will apply to subsequent billing cycles, not to the current subscription period.

4.5 Refunds

Subscription fees are generally non-refundable. However, we may provide refunds or credits at our sole discretion in certain circumstances.

5. Free Trial

We may offer free trials. At the end of your trial, your account will automatically convert to a paid subscription unless you cancel before the trial ends. No payment will be charged during the trial period.

6. User Content

6.1 Ownership

You retain all rights to Content you upload to the Service. By uploading Content, you grant us a license to use, store, and process that Content to provide the Service.

6.2 Responsibility

You are solely responsible for your Content and must ensure it:

• Does not infringe any third-party intellectual property rights
• Does not violate any applicable laws or regulations
• Does not contain malicious code or viruses
• Is accurate and not misleading

6.3 Content Removal

We may remove Content that violates these Terms or that we determine is harmful, offensive, or otherwise objectionable.

The Service, including all software, designs, text, graphics, and other materials, is owned by or licensed to Digitallog S.r.l. and is protected by intellectual property laws. You may not:

• Copy, modify, or distribute our intellectual property without permission
• Reverse engineer or decompile our software
• Remove any proprietary notices or labels
• Use our trademarks without written consent

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT:

• The Service will be uninterrupted or error-free
• Defects will be corrected
• The Service is free of viruses or harmful components
• The results obtained from using the Service will be accurate or reliable

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DIGITALLOG S.R.L. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of profits, revenue, or data
• Business interruption
• Cost of substitute services
• Any damages arising from third-party integrations

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify and hold harmless Digitallog S.r.l. and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service or violation of these Terms.

13. Termination

13.1 By You

You may cancel your subscription at any time through your account settings. Cancellation will take effect at the end of your current billing period.

13.2 By Us

We may suspend or terminate your account if you violate these Terms, fail to pay fees, or for any other reason at our discretion with reasonable notice.

13.3 Effect of Termination

Upon termination, your right to use the Service will cease. You may export your data within 30 days of termination. After that period, we may delete your data.

14. Governing Law and Disputes

These Terms are governed by the laws of Italy. Any disputes shall be resolved exclusively in the courts of Rome, Italy, unless otherwise required by applicable consumer protection laws.

15. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes via email or through the Service at least 30 days before they take effect. Continued use of the Service after changes constitutes acceptance.

16. General Provisions

• Entire Agreement: These Terms constitute the entire agreement between you and us
• Severability: If any provision is found invalid, the remaining provisions remain in effect
• No Waiver: Failure to enforce any right does not waive that right
• Assignment: You may not assign these Terms without our consent
